Approaches to promoting a more efficient and effective restructuring regime
During this session the panelists shared their experiences regarding insolvency/bankruptcy law characteristics (substantive and procedural) that often impact the successful reorganisation (or other dispositions) of financially-troubled enterprises, including the following: balancing debtor and creditor rights, disclosure and transparency, significance of enterprise insolvency, enterprise control (trustees and existing management), financing, specialised judges and adequacy of resources, other specialized agencies, competency and training of professionals, the expense-speed dynamic, planning, coalition building, and predictability and precedence.
Simultaneous translation in both English and Arabic was provided.
