With increasingly complex relationships prevailing between aspects of insolvency, civil and criminal laws, and as technology continues to redefine the way tracing and recovery processes are undertaken, INSOL International’s dedicated Asset Tracing & Recovery (ATR) group was launched at INSOL International’s London Conference 2022 to address the sophisticated nature of issues facing practitioners as they work to protect and preserve both traditional and digital asset classes.

The group’s primary focus is on the following legal and non-legal considerations:

  • Judgment recognition
  • Asset identification, tracing and recovery
  • Legal tools, ancillary to formal insolvency proceedings
  • Privacy issues
  • Digital assets and cryptocurrencies

By drawing upon the deep expertise of INSOL International’s membership, the ATR group’s overriding aims are to steer and shape future directions for law reform, develop best practice guidance and facilitate the sharing of information and ideas across this specialism amongst INSOL International’s members.

The committee is currently working to develop a practice guide to synthesise the legal tools adopted in various jurisdictions in relation to ATR. Outlines for the guide have been progressed and anyone interested in contributing to the guide should contact Sarah Mylott.
